Privacy Policy

We are committed to protecting the privacy of all visitors to the FairMeals Site, including all visitors who access the Website or Service through any mobile application or other platform or device. Please read the following Privacy Policy, which explains how we use, process and protect your information. This Privacy Policy is valid for users registering on or after the 25.05.2018 and replaces the Privacy Policy from the 01.11.2017 for all existing users.

This Privacy Policy applies to all personal data processed by us in connection with our Online Services. However, this Privacy Policy only applies to the processing of personal data by us and not the processing of personal data by third parties. To the extent permitted by applicable regulations, we do not assume responsibility for the processing of personal data by third parties.

By visiting and/or using the Service on the FairMeals Site, you agree and where required you consent to the collection, use and transfer of your information as set out in this policy.

Privacy, security and online safety are important for us, and we process all personal data with due care and in accordance with applicable laws and regulations.

Just B-D is responsible for the personal information collected through the FairMeals Site and the Service. We can be contacted according to the information listed in paragraph 9.

1. Information that we collect from you

1.1 When you visit the Website or use the Service to make an Order from a Store through the Website, you may be asked to provide information about yourself including your name, contact details (such as telephone and mobile numbers and e-mail address). We may also collect information about your usage of the Website and Service, information about you from the materials (such as messages and reviews) you post to the Website or from participations in competitions arranged by us, and e-mails or letters you send to us.

1.2 By accessing our information and/or the Website or Service using mobile digital routes such as (but not limited to) mobile, tablet or other devices/technology including mobile applications, you should expect that our data collection and usage as set out in this Privacy Policy will apply in that context too. We may collect technical information from your mobile device or your use of the Website or the Service through a mobile device, for example, location data and certain characteristics of, and performance data about your device, carrier/operating system including device and connection type, IP address, mobile payment methods, interaction with other retail technology such as use of NFC Tags, QR Codes or use of mobile vouchers. Unless you have elected to remain anonymous through your device and/or platform settings, this information may be collected and used by us automatically if you use the Website or Service through your mobile device(s) via any Just B-D mobile application, through the browser of your mobile device or otherwise.

1.3 Generally, the Services automatically collect usage information, such as the number and frequency of visitors to the Site or mobile application. We may use this data in aggregate form, that is, as a statistical measure. This type of aggregate data enables us and third- parties authorized by us to figure out how often individuals use parts of the Services so that we can analyze and improve them. When you visit the Site, we may also collect information about your online activities over time and across third-party websites or online services. 1.4 Blog: We have public blogs on our Websites. Any information you include in a comment on our blog may be read, collected, and used by anyone.

1.5 Social media platforms and widgets. Our Websites include social media features, such as the Facebook Like button. These features may collect information about your IP address and which page you are visiting on our Website, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Website. We also maintain presences on social media platforms including Facebook, Instagram, LinkedIn, Youtube, and Xing. Any information, communications, or materials you submit to us via a social media platform is done at your own risk without any expectation of privacy. We cannot control the actions of other users of these platforms or the actions of the platforms themselves. Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them.

1.6 Links to third-party websites. Our Websites include links to other websites, whose privacy practices may be different from Just B-D’s. If you submit Personal Information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any Website you visit.

1.7 Email communications: We may receive a confirmation when you open an email from us. We use this confirmation to improve our Services, including customer service.

1.8 Location data: Some of our Services, such as mobile applications, may collect geo- location data (which determines your current location) to provide location- related Service functionality. We may link location data to other information we have collected about you for the purposes described in this Privacy Policy. You may stop sharing your location data by adjusting your mobile device’s location services settings. For instruction on changing the relevant settings, please contact your service provider or device manufacturer.

2. Use of your information

2.1 Your information will enable us to provide you with access to the relevant parts of the Website and to provide the Service. It will enable us and/or a Store with whom you have placed an Order to contact you if necessary concerning the Service. For example, we and/or the Store may use your information to provide you with status updates or other information regarding your Order by e-mail, telephone, mobile or mobile messaging (e.g. SMS, MMS etc.). We will also use and analyze the information we collect so that we can manage, support, improve and develop our business, for any other purpose whether statistical or analytical and to help us prevent fraud. Where appropriate, now and in the future you may have the ability to express your preferences around the use of your data as set out in this Privacy Policy and this may be exercised through your chosen method of using the Service, for example mobile, mobile applications or any other representation of the Website.

2.2 We may use your information to contact you for your review of the Service and to notify you occasionally about important changes or developments to the Website or the Service.

2.3 If you have indicated accordingly, you accept that we may use your information to let you know about our other products and services that may be of interest to you. This includes services that may be the subject of direct marketing and we may contact you to do so by post, telephone, mobile messaging (e.g. SMS, MMS etc.) as well as by e-mail.

2.4 If you have indicated accordingly, you accept that we may also share information with third-parties (including those in the food, drink, leisure, marketing and advertising sectors) to use your information in order to let you know about goods and services which may be of interest to you (by post, telephone, mobile messaging (e.g. SMS, MMS etc.) and/or e-mail) and to help us analyze the information we collect so that we can manage, support, improve and develop our business and services for your benefit.

2.5 We may disclose Personal Information to the following types of third parties for the purposes described in this policy:

(a) Service providers. Sometimes, we need to use third party Service Providers in order to provide and support the features of our Services. For example, if it is necessary to provide you something you have requested (like send you a T-shirt or enable a feature such as Social Profiles), then we may share your Personal Information with a Service Provider for that purpose. We will tell you we are working with a Service Provider whenever reasonably possible, and you may request at any time the names of our Service Providers. Just like with the other third parties we work with, these third party Service Providers enter into a contract that requires them to use your Personal Information in a manner that is consistent with this policy.

(b) Advertising partners. We may partner with third parties to display advertising on our Websites or to manage and serve our advertising on other sites and may share Personal Information with them for this purpose. All third parties with whom we share this information are required to use your Personal Information in a manner that is consistent with this policy. We and our third party partners may use cookies and other tracking technologies, such as pixels and web beacons, to gather information about your activities on our Websites and other sites in order to provide you with targeted advertising based on your browsing activities and interests.

2.6 If you do not want us to use your data in this way or if you change your mind about being contacted in the future, please let us know by using the contact details set out in paragraph 8 below and/or amending your profile accordingly.

2.7 Please note that by submitting Reviews regarding the Website, Service and/or Stores, you consent to our use of such Reviews on the Website and in any marketing or advertising materials. We will only identify you for this purpose by your first name and the city in which you reside (and any other information that you may in each case consent to).

3. Disclosure of your information

3.1 The data handled within our service platform for Users and Gastronomy Businesses is stored within the EU/EEA. For our website functions we use service providers in several geographical locations, such as Google Analytics and Hubspot. As such, our service providers and we may transfer personal data to, or access it in, jurisdictions outside the European Economic Area or the User’s domicile. Any such transfer of your Personal Data will be carried out in compliance with applicable laws. All service providers have limited access to your information. To perform the tasks on our behalf service providers are contractually bound to ensure that the data is processed in accordance with the current legislation and this Privacy Policy.

3.2 The third-parties with whom we share your information may undertake various activities such as providing services for us; data processing services, analytic services or customer care improvement services.

3.3 We may need to provide your information to any Store that you have placed an Order with, so as to allow the Store to process your Order. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

3.4 If you have given your consent, we may allow carefully selected third-parties, including marketing and advertising companies, our affiliates and associates, to contact you occasionally about services that may be of interest to you. They may contact you by post, telephone, mobile messaging (e.g. SMS, MMS, etc.) as well as by e-mail. If you change your mind about being contacted by these companies in the future, please let us know by using the contact details set out in paragraph 8 below and/or by amending your profile accordingly.

3.5 If our business enters into a joint-venture with, purchases- or is sold to- or merged with another business entity, your information may be disclosed or transferred to the target company, our new business partners, owners or their advisors.

3.6 We may use the information that you provide us, if we are under a duty to disclose or share your information in order to comply with (and/or where we believe we are under a duty to comply with) any legal obligation; or in order to enforce the Website Terms and any other agreement; or to protect our rights or the rights of Stores or other third parties. This includes exchanging information with other companies and other organizations for the purposes of fraud-protection and prevention.

4. Security and data retention

4.1 We take all necessary steps to protect your information from unauthorized access and against unlawful processing, accidental loss, destruction or damage. We will keep your information for a reasonable period of time, in accordance with the purposes for which we have collected such information, or as long as the law requires.

4.2 If you have chosen a password which allows you to access certain parts of the Website, you are responsible for keeping this password confidential. We advise you not to share your password with anyone. Unless we negligently disclose your password to a third party, we will not be liable for any unauthorized transactions made by using your name and password.

4.3 The transmission of information through the internet involved risks. Although we will take steps to protect your information, we cannot guarantee the security of your data transmitted to the Website; any such transmission is at your own risk. Once we have received your information, we will seek to prevent unauthorized access, by using strict procedures and security-features. In case any security violation occurs despite the measures we have implemented, we will contact you without undue delay.

5. Information from the use of our Mobile Apps

When you use our mobile apps, we may collect certain information in addition to information described elsewhere in this Policy. For example, we may collect information about the type of device and operating system you use. We may ask you if you want to receive push notifications about activity in your account. If you have opted in to these notifications and no longer want to receive them, you may turn them off through your operating system. We do not ask for, access or track any location-based information from your mobile device at any time while downloading or using our Mobile Apps or Services. We may use mobile analytics software (such as Google Analytics) to better understand how people use our application. We may collect information about how often you use the application and other performance data.

6. User’s rights

6.1 Right to access: we offer access for Users to the personal data processed by us. Hence, Users may contact us and we can inform what personal data has been collected and processed for that user. Likewise, the purposes for the data use can be provided.

6.2 Right to correct: users have the right to correct or complete any incorrect, imprecise, incomplete, outdated or unnecessary personal data.

6.3 Right to data deletion: users may ask to delete their personal data from our system. We will comply with such request unless we have a legitimate ground to not delete the data. We may not immediately be able to delete all residual copies from our servers and backup systems after the active data have been deleted. Such copies shall be deleted as soon as reasonably possible.

6.4 Right to withdraw consent: In case the processing is based on a consent granted by the User, then the User may withdraw the consent at any time. Withdrawing a consent may lead to fewer possibilities to use our Services.

6.5 Right to object: Users may object to certain use of personal data if such data are processed for other purposes than purposes necessary for the performance of our Services to the User or for compliance with a legal obligation.
Users may also object any further processing of personal data after prior given consent. If a User objects the further processing of personal data, this may lead to fewer possibilities to use our Services.
Notwithstanding any consent granted beforehand for the purposes of direct marketing, the User has the right to prohibit us from using the User’s personal data for direct marketing purposes, market research and profiling by contacting us on the addresses indicated above or by using the functionalities of the Services or the unsubscribe possibility offered in connection with any direct marketing messages.

6.6 Right to restriction of processing: Users may request us to restrict certain processing of personal data, this may however lead to fewer possibilities to use our Services.

6.7 Right to data portability: Users have the right to receive their personal data from us in a structured and commonly used format and to independently transmit those data to a third party.

6.8 How to use your right: The above mentioned rights may be used by sending a letter or an e-mail to us on the addresses set out in paragraph 9, including the following information: name, address, phone number and a copy of a valid ID. We may request the provision of additional information necessary to confirm the identity of the User.
We may reject requests that are unreasonably repetitive, excessive or manifestly unfounded.

7. Changes to our privacy policy

Any changes to our Privacy Policy will be posted to the Website and, when appropriate, through e-mail notification.

8. Complaint about use of information and data

You have the opportunity to complain about our use of information and data relating to you. Such a complaint against the processing of information should be filed under the General Data Protection Regulation from the European Commission and German law.
